Welcome to BlueElement.ai. These Terms of Service (“Terms”) govern your access to and use of our website, platform, and related products and services (“Services”). The Services are operated by ImageMetry s.r.o., Czech Republic (“BlueElement”, “we”, “us”, or “our”). If you are using the Services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

BlueElement.ai provides an online platform offering AI-based analytics and related software tools. Features and functionality may change over time. We may modify, suspend, or discontinue the Services at our discretion to improve performance, comply with law, or protect our systems. You acknowledge that the Services may not be available without interruption and may contain errors. We are not responsible for any unavailability, modification, or discontinuation.

You agree to use the Services only for lawful business purposes and in compliance with all applicable laws and regulations. You are responsible for keeping your login credentials secure and for all activities occurring under your account.

You receive a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes during the term of your access.
You retain ownership of your own input and output data. We do not claim ownership of your data and do not use it to train public or third-party AI models.
4. AI-Generated Content
The Service may generate or suggest AI-created content. Such content may contain errors, inaccuracies, or inappropriate outputs.
We make no guarantees as to the accuracy, completeness, or suitability of any AI-generated information.
You remain solely responsible for reviewing, verifying, and deciding how to use any AI-generated output.
5. Payments and Subscriptions
Certain features may require payment. By subscribing, you agree to pay all fees associated with your selected plan and authorize our payment processor (e.g., Stripe) to charge your chosen payment method. Subscriptions renew automatically unless canceled before the renewal date. We may update pricing with reasonable prior notice.
All fees are non-refundable, except as required by applicable law. We have no obligation to provide refunds for partial use, downgrades, or unused periods.

We aim to provide reliable access but do not guarantee uninterrupted operation, error-free performance, or specific outcomes.

We provide the Service on an “as is” and “as available” basis and make no warranties or representations of any kind. You use the Service entirely at your own risk.
In no event shall our aggregate liability exceed the amount you have actually paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim. If you have used the Service free of charge, our liability shall be zero.

You agree to indemnify and hold harmless ImageMetry s.r.o., its affiliates, officers, and employees from and against any claims, losses, damages, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

These Terms constitute the entire agreement between you and BlueElement.ai regarding the Service.
No verbal agreements or prior understandings apply.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain fully effective.
